No Written Contract with Your Nanny? 7 Risks You Don’t Want to Discover Too Late
She’s lovely. A friend recommended her. Your child liked her from the first meeting. You agreed on an hourly rate, and she starts on Monday.
But you never signed a contract.
“Why bother with paperwork? We trust each other.”
Then one day, you remember the arrangement differently. Your babysitter doesn’t turn up. A disagreement arises over payment. Or something happens that neither of you was prepared for.
At that point, the question is no longer how likeable your nanny seemed. It’s what you agreed, what you can prove, and who is responsible for what.
When choosing a babysitter, most parents focus on experience, personality and hourly rates. Understandably, you want someone your child feels safe and comfortable with.
But safe childcare also depends on clear working arrangements. Who agrees to do what? How are payments handled? What happens in an emergency? And what happens when things don’t go as planned?
These questions deserve answers before the first childcare session.
No Written Contract? Rights and Obligations May Still Exist
Let’s clear up an important misconception: the absence of a written contract does not automatically mean that no legally binding agreement exists.
Under Hungarian civil law, where no particular form is required, an agreement can be made verbally or through conduct. The practical weakness of a verbal agreement is that its precise terms may be harder to prove if a dispute arises. Hatályos Jogszabályok Gyűjteménye
Different rules apply where a nanny works under a standard employment relationship: Hungary’s Labour Code requires an employment contract to be in writing. The appropriate legal arrangement depends on how the relationship actually operates. Nemzeti Jogszabálytár
Messages and payment records may help establish what was agreed. But a few chat messages will not necessarily explain how a cancellation, an injury or an unexpected situation should have been handled.
“We discussed it” is reassuring only while you both remember the same conversation.
1. An Accident Happens—and Only Then Do You Discuss Responsibility
Your child falls at the playground. They develop symptoms of an allergic reaction. Your babysitter cannot reach you by phone.
Was the nanny informed about the allergy? What instructions did you provide? Who should have been contacted? How should the incident be documented?
These questions should be addressed before childcare begins. In an emergency, getting immediate help and caring for the child take priority; clear instructions support that response.
An accident alone does not establish that a babysitter is legally responsible. Equally, the absence of a written contract does not automatically remove any potential liability. The circumstances, agreed obligations and applicable legal rules must be considered. Hatályos Jogszabályok Gyűjteménye
A detailed agreement and written care instructions help reduce uncertainty when a difficult situation arises.
2. You Asked for Childcare. Your Nanny Understood Something Different.
You assume your nanny will prepare a snack, put away your child’s toys and collect them from nursery.
Your nanny understood that the job involved supervising your child at home, without additional duties.
The disagreement becomes particularly sensitive if you have not clearly agreed:
whether the nanny may take your child outside;
whether they may drive with your child;
who is authorised to collect your child;
whether visitors are permitted;
which childcare and household duties are included.
“Please look after them” is too broad to answer every important question.
One of the most valuable purposes of a nanny contract is to make expectations and boundaries clear.
Your child’s routine, dietary requirements, allergies and individual needs can also be recorded in a separate care document that you update when necessary.
3. The Hourly Rate Was Clear. The Final Bill Wasn’t.
“We agreed on four hours.”
“Yes, but you got home later.”
“I thought travel expenses were included.”
“And I thought you would pay for the cancelled session.”
Agreeing on an hourly rate is only one part of the financial arrangement. It is equally important to clarify:
when and how payment is made;
how additional time is calculated;
which extra expenses may apply;
what happens if a booking is cancelled;
how completed hours and payments are recorded.
Paying in cash is not inherently unlawful. However, it is sensible to document when you paid, how much you paid and which period the payment covered.
Clear payment arrangements protect both the family and the babysitter.
4. You Signed a Document—but the Legal Arrangements Are Still Incomplete
This distinction matters: a contract and any required registration are two separate responsibilities.
In Hungary, childcare provided between private individuals may qualify as household work if the statutory conditions are met. Under this arrangement, the person engaging the household worker must register them with the Hungarian tax authority, NAV, before work begins.
Properly arranged household work may be exempt from taxes and contributions. Failure to register it can result in tax and contribution liabilities and a default penalty. These rules do not automatically apply to childcare services supplied by a business. nav.gov.hu
It is also important to understand that household work does not, in itself, give the worker insured status under Hungary’s social security system. This is a separate issue from liability insurance. nav.gov.hu
A downloaded nanny contract template cannot determine which legal arrangement applies to your situation or fulfil the associated obligations for you.
5. Your Child’s Photos and Your Family’s Private Life Become Accessible
Your nanny gets to know your home, your routine and when you are away. They may see family documents and learn about your child’s health.
This is a natural part of working closely with a family. It is also why clear rules for handling confidential information matter.
May the nanny photograph your child? Who may receive those photos? May they appear on social media? How should house keys and entry codes be handled? What happens to them when the arrangement ends?
A reassuring photo sent privately to a parent and a public social media post are two very different situations.
Trust also means understanding and respecting the boundaries of your family’s private life.
6. Your Nanny Cannot Come Tomorrow—and There Is No Agreed Next Step
At seven in the morning, a message arrives: “I’m sorry, I can’t come today.”
You need to leave for work. Your child is at home. The grandparents are unavailable.
A contract cannot prevent illness, and it does not automatically guarantee replacement care. But it can clarify how absences should be communicated, how cancellations are handled and how the arrangement may be brought to an end.
If you use a childcare provider, ask how replacement care is coordinated and under what conditions an alternative caregiver may be offered.
“We’ll sort it out” is reassuring when you know whom to contact and what to expect.
7. “There’s Insurance” May Tell You Very Little
The fact that someone has insurance does not necessarily mean that the particular childcare activity or incident is covered.
Useful questions include:
Who is insured?
Which activities does the policy cover?
What limits and exclusions apply?
How must a claim be reported?
Without understanding the policy terms, you cannot assess what protection it actually provides.
A contract does not create insurance coverage. Insurance does not replace clear contractual arrangements.
What Should a Nanny or Babysitter Contract Include?
The precise content depends on the legal relationship, but the following questions should have clear answers:
Who are the contracting parties? Are you entering into an agreement directly with the caregiver or with a service provider?
What are the duties? Which children will be cared for, where and through which activities?
When will childcare take place? How are sessions agreed and changed?
What are the fees? When is payment due, and which additional costs may apply?
What happens if a session is cancelled? Which conditions apply to each party?
Which safety rules must be followed? Who may collect your child, and who should be contacted if a problem occurs?
How will confidential information and photographs be handled?
How will incidents and concerns be documented and addressed?
How does the arrangement end? How are outstanding payments settled and keys returned?
A contract is useful when both parties understand it, accept it and follow it in practice.
A Written Contract Protects Your Nanny Too
A childcare professional also needs to know what they are agreeing to do, when they will be paid and how their work arrangements may change.
A written agreement can help prevent a constantly expanding list of duties, uncertain payments and conflicting expectations.
Clear, fair terms support a more stable working relationship. That stability matters to your child too.
Frequently Asked Questions About Childcare Without a Written Contract
Is a written nanny contract compulsory in Hungary?
It depends on the legal relationship. A standard employment relationship requires a written employment contract. Other arrangements may be governed by different rules. Recording childcare duties and conditions in writing is advisable in any case. Nemzeti Jogszabálytár
Is a Messenger conversation enough?
Messages may help prove what was agreed, but they will not necessarily address every important issue or automatically satisfy every legal requirement concerning the form of an agreement.
Is a written agreement worthwhile for just one evening?
Yes. Even for a single booking, it is sensible to document the fee, duration, duties and essential safety information. A short booking does not, by itself, resolve the legal relationship or any applicable registration obligations.
Is a nanny agency automatically responsible for everything?
Responsibility depends on the applicable rules and the contractual arrangement. Check whom you are contracting with, who supplies the service and which obligations they undertake.
